270,000 Ohio Employers Win Workers' Comp Ruling | NBC 4i

Ohio overcharged about 270,000 businesses for workers' compensation premiums and must repay them, a county judge said.

It's a ruling could that cost the state hundreds of millions of dollars.

The Ohio Bureau of Workers' Compensation plans to appeal the decision issued Friday.

A group of mostly small businesses sued Ohio in 2007 for $1.3 billion, saying that they paid too much for their workers' compensation premiums between 2001 and 2008.

Cuyahoga County Judge Richard McMonagle agreed but has asked the group to lower their monetary request because they are not owed interest on the premiums.

"It will be something less than a billion dollars, but still a substantial amount of money," said Jim DeRoche, an attorney for the businesses.

He said the ruling will end up being good for the state's economy because the money will go to small businesses.

"This ruling gives the state the opportunity to help the hundreds of thousands of Ohio employers grow their businesses, create jobs and move Ohio forward," DeRoche said.

The judge set a final hearing for March 14 to determine how much money should be paid.

"While we are disappointed in the decision, we continue to maintain that our actions were lawful and that the plaintiffs' claims are without merit," Bill Teets, a spokesman for workers' compensation bureau, told The Plain Dealer.?

The lawsuit said the bureau gave discounted premiums to companies that joined for group insurance plans and charged companies not in the groups excessive rates to pay for the discounts.

Companies paying group rates were not charged premiums that covered their losses, lawyers for the small businesses said. That forced the other companies to cover the difference, they said.

The bureau discounted its group plans as high as 90 percent.

McMonagle already ordered the bureau three years ago to change its system for setting premiums for injury insurance. The maximum discount set by the bureau for group plans is 53 percent.

State Dept. warns Americans about Haiti travel

(AP) ? The State Department has issued a revised Haiti travel advisory, warning Americans planning to travel to the Caribbean island nation about robbery, lawlessness, infectious disease and poor medical facilities.

"U.S. citizens have been victims of violent crime, including murder and kidnapping, predominantly in the Port-au-Prince area. No one is safe from kidnapping, regardless of occupation, nationality, race, gender or age," the department said.

The new travel warning was released Friday to replace a less strongly worded advisory issued in June.

In recent months, travelers arriving in Port-au-Prince, the capital and largest city, on flights from the United States have been attacked and robbed after leaving the airport. This year, at least two U.S. citizens were shot and killed in robbery and kidnapping incidents, the State Department said.

"Haitian authorities have limited capacity to deter or investigate such violent acts or prosecute perpetrators," the department said.

The State Department also noted that while the incidents of cholera have declined, the disease persists in many areas of Haiti. Medical facilities, including ambulance services, are particularly weak.

"Thousands of U.S. citizens safely visit Haiti each year, but the poor state of Haiti's emergency response network should be carefully considered when planning travel. Travelers to Haiti are encouraged to use organizations that have solid infrastructure, evacuation and medical support options in place," the department said.

Venezuela sees 2012 inflation at 19.9 percent, below target

CARACAS (Reuters) - Venezuelan inflation reached 19.9 percent in 2012, the central bank said in a preliminary estimate on Saturday, beating its official target thanks to strict price controls that business leaders say are unsustainable in the long term.

The government of President Hugo Chavez has capped prices for a wide range of consumer goods, helping contain inflation that has traditionally been the highest in Latin America. The 2012 target had been between 22 and 25 percent.

But inflation is seen accelerating in 2013 because Venezuela is expected to devalue the bolivar currency after heavy campaign spending this year that helped ensure Chavez's re-election.

Devaluing eases fiscal pressure on the government by providing more bolivars for each dollar of crude exports, but also pushes up the cost of importing basic consumer goods that are not produced in the oil-dependent country.

In late 2011, when prices rose 27.6 percent, the government began extended a system of controls that now regulate prices of products ranging from deodorant to meat while fixing profit margins.

This helped keep prices in check in an election year despite heavy government spending on welfare programs ranging from construction of homes for the poor to monthly cash stipends for single mothers.

But business leaders say the controls have kept prices artificially low, and that inflation is likely to bounce back.

Authorities on Thursday released preliminary estimates showing the country's economy grew 5.5 percent in 2012, with the construction sector among the fastest-growing thanks to a state homebuilding program.

L.A. offers groceries for guns in annual buyback

LOS ANGELES (AP) ? Long lines of cars and people formed Wednesday to take advantage of a guns-for-groceries exchange program that was moved up in the wake of the Connecticut school shooting.

Police officers filled bins with more than 1,500 rifles and handguns outside the Los Angeles Memorial Sports Arena and the Van Nuys Masonic Temple, according to the Los Angeles Daily News.

Officials were mindful of both the massacre of students and teachers in Newtown, Conn., and a gunman's ambush that killed two firefighters in Webster, N.Y.

"All of us are still mourning the tragedy at Newtown, Conn.," said Mayor Antonio Villaraigosa. "So many young innocent children were mass-murdered in the way that they were, and now the assassination of two firefighters ... just breaks the heart of so many of us, particularly in this holiday season."

The anonymous buyback program allowed weapons to be turned in with no questions asked. Handguns, rifles and shotguns could be exchanged for $100 Ralphs grocery store gift cards. Assault weapons earned a $200 card.

The program, designed to get guns off the streets, usually is held in May. Villaraigosa decided to do it now in the wake of the Dec. 14 shooting rampage at Sandy Hook Elementary School.

The last buyback netted about 1,700 guns.

There's no official word from Samsung on its authenticity, although we wouldn't be surprised knowing the company's history and the Note II's strong track record. While it isn?t as popular as Netflix, and probably never will be, Vudu Movies and TV streaming has offered media mavens an alternative place to view, rent, or purchase digital version of all their favorite films. In fact, many studios are supporting Vudu, with blu-ray/DVD copies of movies coming with a Vudu digital copy promo code. Now you can stream those movies to your Android device, and it works well too. It?s great to be able to watch a solid selection of mobile movies on the go, even if this is far from the first app to let you do so. All in all, it?s a pretty cool service.

No matter what the application is or how full featured it may be, developers always find room for improvement. Even something as simple as a keyboard can be vastly tweaked to offer new features and customization options. That?s where Kii Keyboard comes in. It offers some slick new ways to type, such as gesture-based typing and smart word predictions. You can also make use of plenty of different themes and set your own photos as the keyboard background image. Go ahead and give it a try.

This is a very specific app for a certain group of people, and I?m sorry to include something so exclusionary on this list, but it?s been a slow week, and I have a personal bias on this topic. SpotHero is a brilliant app for people who live in the Chicago area, where this lovely website is based and where I grew up. It?s meant to find cheap parking by comparing and contrasting various garages by location. This is an impressive feat, I assure you, especially since the app offers some exclusive discounts just for owning it. You can even reserve parking spots ahead of time. It?s just awesome, and hopefully they branch out to include other major metropolitan areas in the near future.

Some alarm clocks have you solve a sliding tile puzzle and a few calculus problems before shutting off an eardrum destroying wail, which believe me, some people really desperately need. If you?re more of a morning person, and are concerned with style and simplicity with your alarm clock apps, then look no further than Wave Alarm. It?s a slick new alarm clock app that uses your device?s front facing camera as something of a motion tracker, letting you snooze or shut off your alarm with a simple motion. It boasts plenty of other features as well, such as real time weather updates and music library alarm choices.

Flock is an interesting new app that gets an A+ for effort and innovation, but a C- or so in execution. Essentially, it?s a photo sharing app that seeks to separate itself from Facebook and the rest, making it easier for you to find photos based on time and location taken rather than sift through a dozen albums online. Using facial recognition, it auto-tags your friends and creates albums for you with no real input. You don?t even have to open the app to use it. Unfortunately, the software needs some work, with a lot of bugs and wonky features, but definitely keep your eye on this one.

The latest filing leaving us scratching our heads is for the ASUS P1801-T, a "tablet" which could be the final version of the Transformer AiO prototype we saw back at Computex. How did we arrive at the AiO? Well, the model number is a possible clue -- ASUS' Eee Slate B121 has a 12.1-inch panel, so P1801-T may point to this device having 18 inches of screen. As ASUS' dual-OS prototype all-in-one is the only (sort of) tablet we've seen with roughly that many inches, we assume the company is getting paperwork done before a proper launch at CES 2013. A "P1801" running Android 4.1.1 has also popped up at GLBenchmark, with Tegra 3 graphics and thus a Cortex-A9 CPU inside by default. If ASUS is keeping two OS's as per the AiO prototype, that processor caters for only one Microsoft product -- Windows RT. We'll just be kept wondering until we hear something official, but at least for us, an 18-inch Android / RT super-tablet and part-time desktop sounds like it could be a hard sell.

Egypt approves constitution drafted by Mursi allies

CAIRO (Reuters) - Egyptian voters overwhelmingly approved a constitution drafted by President Mohamed Mursi's allies, results announced on Tuesday showed, proving that liberals, leftists and Christians have been powerless to halt the march of Islamists in power.

Final elections commission figures showed the constitution adopted with 63.8 percent of the vote in the referendum held over two days this month, giving Mursi's Islamists their third straight electoral victory since veteran autocrat Hosni Mubarak was toppled in a 2011 revolution.

Opposition groups had taken to the streets to block what they see as a move to ram through a charter that mixes politics and religion dangerously and ignores the rights of minorities.

Mursi says the text - Egypt's first constitution since Mubarak's fall - offers enough protection for minorities, and adopting it quickly is necessary to end two years of turmoil and political uncertainty that has wrecked the economy.

"I hope all national powers will now start working together now to build a new Egypt," Murad Ali, a senior official in the Muslim Brotherhood's Freedom and Justice Party, told Reuters.

"I see this as the best constitution in Egypt's history."

In a sign that weeks of unrest have taken a further toll on the economy, the government ordered new restrictions on foreign currency apparently designed to prevent capital flight. Leaving or entering with more than $10,000 cash is now banned.

Two years since waves of unrest broke out across the Middle East and North Africa - sweeping away long-entrenched rulers in Tunisia, Libya and Yemen as well as Egypt - well-organized Islamist parties have emerged as the main beneficiaries.

Urban secularists and liberals who were behind the revolts complain that their success has been hijacked.

"We need a better constitution," said Khaled Dawood, an opposition spokesman. "It does not represent all Egyptians."

Mursi's opponents say the new constitution could allow clerics to intervene in lawmaking, while offering scant protections to minorities and women. Mursi dismisses those criticisms, and many Egyptians are fed up with street protest movements that have prevented a return to normality.

Immediately after the announcement, a small group of protesters set tires on fire and blocked traffic near the central Tahrir square, the cradle of Egypt's uprising, but there were no immediate signs of violence or major demonstrations.

Washington, which provides billions of dollars a year in military and other support for Egypt and regards it as a pillar of security in the Middle East, called on Egyptian politicians to bridge divisions and on all sides to reject violence.

"President Mursi, as the democratically elected leader of Egypt, has a special responsibility to move forward in a way that recognizes the urgent need to bridge divisions," State Department spokesman Patrick Ventrell said. He noted that many Egyptians had voiced "significant concerns" over the constitutional process.

WORSENING ECONOMY

The government says its opponents are worsening the economic crisis by prolonging political upheaval. It has pledged to impose unpopular tax increases and spending cuts to win a loan package from the International Monetary Fund.

The ban on travelling with more than $10,000 in cash followed a pledge by the central bank to take unspecified measures to protect Egyptian banks. Some Egyptians have begun withdrawing their savings in fear of more restrictions.

"I am not going to put any more money in the bank and neither will many of the people I know," said Ayman Osama, father of two young children.

He said he had taken out the equivalent of about $16,000 from his account this week and planned to withdraw more, adding that he had also told his wife to buy more gold jewellery.

The "yes" vote paves the way for a parliamentary election in about two months, setting the stage for another battle between surging Islamists and their fractious opponents.

The final result, announced by the election commission, matched - to the last decimal place - an earlier unofficial tally announced by Mursi's Muslim Brotherhood.

But the opposition said it was disappointed - it had appealed for the result to be amended to reflect what it described as major vote violations during the two-round vote.

Officials said there were no violations serious enough to change the result significantly. "We have seriously investigated all the complaints," said judge Samir Abu el-Matti of the Supreme Election Committee. The final turnout was 32.9 percent.

SENSE OF CRISIS

The referendum has sharpened painful divisions in the Arab world's most populous nation and a growing atmosphere of crisis has gripped Egypt's polarized society.

Anxiety about the economy deepened this week when Standard and Poor's cut Egypt's long-term credit rating. Prime Minister Hisham Kandil told the nation of 83 million on Tuesday the government was committed to fixing the economy.

"The main goals that the government is working towards now is plugging the budget deficit, and working on increasing growth to boost employment rates, curb inflation, and increase the competitiveness of Egyptian exports," he said.

The referendum follows Islamist victories in parliamentary and presidential elections, representing a decisive shift in a country at the heart of the Arab world where Mursi's Muslim Brotherhood was suppressed for generations by military rulers.

However, secularist and liberal opposition members hope they can organize better in time for the next parliamentary vote.

Hossam El-Din Ali, a 35-year-old newspaper vendor in central Cairo, said he agreed the new constitution would help bring some political stability but like many others he feared the possible economic austerity measures lying ahead.

"People don't want higher prices. People are upset about this," he said. "There is recession, things are not moving. But I am wishing for the best, God willing."

(AP) ? One of Egypt's leading opposition figures on Monday pledged continued resistance to his country's Islamist-oriented constitution even if it is declared to have passed, contending that the process was fundamentally illegitimate.

Unofficial tallies say nearly two-thirds voted in favor of the draft constitution, but turnout was so low that opponents are arguing that the vote should be discounted.

Hamdeen Sabahi, who placed third in the nation's first free presidential race over the summer, said in an interview with The Associated Press that the majority of Egypt's people are not Islamists.

He argued that the string of election triumphs by President Mohammed Morsi's Muslim Brotherhood group are the result of unfair electoral practices and key mistakes by the liberal opposition, particularly a lack of unity and organization.

"The Muslim Brotherhood is a minority ? this is for sure. They get majority votes because of division within the opposition," he said. "If there is transparency (in voting) and unity among civil groups, then surely the majority will turn from the Brotherhood."

Sabahi said the Islamist groups in the country "for sure have tried to steal" the revolution that toppled authoritarian President Hosni Mubarak neat two years ago ? "but we will prevent them."

Sabahi said the National Salvation Front ? a union of key opposition forces that coalesced in the fight against the draft constitution ? is not calling for civil disobedience in rejection of the Islamist-drafted constitution, but for a new constitution through peaceful means.

The path toward such an outcome appears uncertain at best ? especially as Sabahi rejected the notion, somewhat plausible in Egypt, of the military stepping in to undo the inconvenient outcomes of politics.

In a sign of the opposition leadership's efforts to coalesce, Sabahi said the grouping would be led in the interim by Nobel laureate Mohamed ElBaradei, the former head of the Vienna-based United Nations nuclear agency.

No confirmation of that was immediately available from ElBaradei.

In the interview, the silver-maned, charismatic former journalist seemed to embody the frustrations of liberal Egyptians today: While championing the democracy and lauding the 2011 revolution that felled Mubarak, they reject the outcome of that revolution, yet seem at something of a loss to cause a change of course.

Tens of thousands of Egyptians took to the streets weeks before the referendum to demand a new assembly with greater diversity write the charter. Instead, an Islamist-dominated assembly hurriedly passed it before a court could rule on the body's legitimacy, and Morsi himself issued decrees, later rescinded, that gave him near absolute powers to push the constitution to a referendum.

Backers of the Brotherhood and others Islamist parties also rallied in support of the charter, leaving the country split and leading to violent clashes between the two camps that killed 10 outside the presidential palace in Cairo this month. That created the impression that street protests can be conjured up to support either side in the current divide.

But only around 30 percent of eligible voters participated in the referendum on the divisive charter. Of that number, unofficial figures estimate that 64 percent voted in support of it.

Sabahi said the low voter turnout shows people were not convinced by the Brotherhood's slogans ? nor with the opposition's.

"This means that the battle for politics is concentrated on survival, food, jobs and prices ? daily struggles that are the priority of all Egyptians," he said.

Under such circumstances, he said, it was illogical to enshrine the document as a constitution that can be amended only by supermajorities in parliament.

Critics say the new constitution seeks to entrench Islamic rule in Egypt and that the charter does not sufficiently protect the rights of women and minority groups. Morsi and his supporters say the constitution is needed to restore stability in the country, install an elected parliament, build state institutions and renew investor confidence in the economy.

In a reflection of the complex nuances at play, Sabahi refused to describe the current conflict roiling Egypt as a clash between secularism and theocracy, saying that in the Arab world, religion and public life could never be distinct in accordance with the Western model.

Rather, he said, the issue was preventing the Brotherhood from establishing a "tyranny" as a political movement not unlike that of the previous authoritarian regime.

He likened Morsi to the ousted leader, Mubarak, saying the Brotherhood is after absolute power.

"He (Morsi) reached power democratically, but is not exercising power democratically," he said, adding that the Brotherhood "wants to establish a system of tyranny in their benefit."

Regarding the fears of theocracy, Sabahi said, "We are against separation of religion and state ... The intellect of the Arab region, and Egypt, is built essentially on religion and specifically the Islamic religion."

Nonetheless, Sabahi said the opposition would continue to fight the constitution, arguing that the low turnout made it illegitimate.

"From the beginning the National Salvation Front said this constitution does not represent the people," he said. "This constitution is not one of national consensus, but of national division."

He said the NSF would now try to remain united in preparation for possible participation in the upcoming parliamentary elections.

He said the front has no immediate plans to unite under one party, but that as a coalition they could win a majority of seats if electoral laws mandated an end to political proselytizing in mosques and placed a limit on the funds used for political campaigns.

Another key issue for the opposition has been enabling people to vote outside their home district. The absence of this has aided the Islamists, who have the money to bus supporters back home to vote. The opposition, though, has also warned that rigging could be made easier if people vote from any location and point to the current use of Brotherhood-manned buses to transport poor voters.

"I am sure that the non-Islamists are the real majority in Egypt. But the Muslim Brotherhood enjoys strong organization, and the forces that oppose them do not have the same organization or finances," he said.

The Brotherhood emerged as the country's strongest political force after the popular uprising that toppled Mubarak nearly two years ago. They won the most seats in parliament, before it was dissolved by the courts, and won the presidency. Liberal and secular groups have consistently failed to beat the Brotherhood at the polls since.

That was until Sabahi, a charismatic populist, appeared as a surprise presidential contender against Morsi and his rival, Ahmed Shafiq, Mubarak's last prime minister, an ex-military man who lured voters with promises of stability.

Sabahi had a last-minute surge after campaigning on promises to help the poor and harkening back to the nationalist, socialist ideology of Gamel Abdel-Nasser, Egypt's president from 1956 to 1970.

Would Sabahi ? known as a fervent opponent of Israel ? cancel the landmark 1979 peace treaty if he one day ascended to power?

No, he said. The main issues facing Egypt today are resolving internal problems, especially endemic poverty ? and he would not risk that priority issue by courting war with a neighbor.

In contrast to the Brotherhood, which has several offices in every Egyptian governorate, Sabahi spoke from the office of a famous Egyptian movie director, who lent him the space.

"The Brotherhood is losing every day. Mohammed Morsi is losing every day," Sabahi insisted, sitting among black and white pictures of Egyptian cinema actors emblematic of the 1960s ? a time of resurgent Arab nationalism less complicated by the politics of religion.

NRA?s defiant LaPierre dismisses critics of school gun plan

Two days after suggesting a "good guy with a gun" be stationed at every school in the country in response to the deadly shootings in Newtown, Conn., National Rifle Association executive vice president Wayne LaPierre blasted critics of his plan.

In an interview broadcast on Sunday's "Meet The Press," LaPierre reiterated the statements he made Friday at a press conference in Washington, when he said the answer to preventing shootings like the one at Sandy Hook Elementary Sch00l is armed security in every school--in effect, protecting children with guns.

?If it?s crazy to call for putting police in and securing our schools to protect our children, then call me crazy," LaPierre said. ?I think the American people think it?s crazy not to do it."

At one point during the often contentious exchange, host David Gregory held up a high-capacity magazine clip that carries 30 bullets, asking if the NRA would support a federal limit on the capacity of such clips.

"Isn't it just possible that we could reduce the carnage in a situation like Newtown?" Gregory asked.

"I don't believe that's going to make one difference," LaPierre responded.

"You're telling me that it's not a matter of common sense that if you don't have an ability to shoot off 30 rounds without reloading, that, just possibly, you could reduce the loss of life?" Gregory asked.

"I don't buy your argument for a minute," LaPierre said. "There are so many different ways to evade that, even if you had that."

?Is there no new gun regulation you would support?? an exasperated Gregory asked. LaPierre refused to answer.

At Friday's press conference, LaPierre--who did not take questions from reporters--argued that had someone at the school been armed, "innocent lives might have been spared."

"The only thing that stops a bad guy with a gun is a good guy with a gun," he said.

Oval Office audio tapes highlight redesigned LBJ Presidential Library

When the Lyndon Baines Johnson Presidential Library and Museum?reopens to the public on Saturday in Austin, Texas ? on what would have been Lady Bird Johnson?s 100th birthday ? visitors will be able to listen to more than 60 Oval Office phone calls and get reacquainted with an animatronic, life-sized version of one of the country?s most colorful presidents.

The library has undergone a year-long, $10 million renovation and now has ?a completely new look and feel,? Mark Updegrove, director of the LBJ Library and Museum, told NBC News. ?We?re using state-of-the-art technology to not only tell the story of what LBJ was doing during his presidency, but also the story of the kind of things that come across a president?s desk and what a president does day to day.?

Updegrove considers the 643 recorded hours of the 36th president?s phone conversations to be the crown jewel of the collection and said selections playing on 11 stations in the library museum allow visitors to hear the president doing everything from persuading members of Congress to pass laws to placing a very specific order for casual pants to wear after work, and seeking ? and getting - advice from his wife, Lady Bird Johnson.

Johnson???who hailed from Stonewall, Texas and served as president from November 22, 1963 until January 20, 1969???was known for using very colorful language. But the audio selections in the new exhibit are neither bleeped?out nor censored. ?There?s a perception that LBJ used worse profanity and did it more often than he actually did,? said Updegrove. ?Yes, he used scatological references and barnyard language, but he was not profane in the way some might think. He never used particularly graphic language.?

In addition to the audio recordings, other new features at the LBJ Presidential Library feature a downloadable app giving visitors the choice of five themed tours, including one in Spanish and one featuring Lady Bird Johnson chatting about various aspects of the White House, and several interactive exhibits that look at how legislation passed under LBJ???including those involving Medicare, voting rights, gun control and seat belts???have an impact on visitors? lives today. And, in keeping with Johnson?s wish that the library tell the story of his presidency ?with the bark off? and share facts that reflect ?not just the joy and triumphs, but the sorrow and failures, too,? historians and consultants such as Michael Beschloss, Robert Dallek, Robert Caro, Doris Kearns Goodwin and former Johnson Administration officials weighed in on the content of the new exhibits.?

?We?re not trying to direct history,? said Updegrove, ?We?re just laying out the facts. We think people will be surprised to learn how much this president did and how it has impacted their lives???whether they think it was right or wrong.?

Not everything in the redesigned LBJ Library is brand new. The replica of the Oval Office, which duplicates President Johnson's office in the White House at 7/8th scale, is unchanged. And the popular storytelling, animatronic LBJ is still here, but in new clothes and in a new location.?

?He used to be in ranching clothes with a Stetson,? said LBJ library spokeswoman Anne Wheeler. "But he also told those stories at dinners, so we have put him behind a podium, in a suit in an exhibit on LBJ Humor which incorporates political cartoons and caricatures from his presidential period.?

There?s one other thing that will be different after the reopening: Until now, the LBJ Library has been the only one of the 13?presidential libraries to offer free admission. Instagram co-founder: Sorry, let's go back to the old advertising policy

After dealing with non-stop outrage ever since it proposed changes to its privacy policy and terms of service on Monday???and despite making some clarifications about the changes???Instagram is throwing in the towel. Back to the old policy ... at least in one regard.

"Because of the feedback we have heard from you," Instagram co-founder?Kevin Systrom wrote in a blog post, "we are reverting [the] advertising section to the original version that has been in effect since we launched the service in October 2010."

The problem with the new advertising policy was that users understood it to mean that Instagram would let advertisers snatch up user-posted images for ads. Many users?wondered if this would mean that they are surrendering their ownership of images by posting them to the service. On Tuesday, Systrom attempted to clarify that this wouldn't be the case. "Instagram users own their content and Instagram does not claim any ownership rights over your photos," he wrote.

As NBC News' Helen Popkin initially pointed out, Instagram never suggested that it would take ownership of your content in the first place. It just sounded as if it was reserving the right to sell your photos, based on the language of the now-abandoned "new" terms of service:?

Instagram does not claim ownership of any Content that you post on or through the Service. Instead, you hereby grant to Instagram a non-exclusive, fully paid and royalty-free, transferable, sub-licensable, worldwide license to use the Content that you post on or through the Service, except that you can control who can view certain of your Content and activities on the Service as described in the Service's Privacy Policy...

Now while things did sound a bit shady, Systrom writes that "Instagram has no intention of selling your photos." Innocent intentions or not, it's back to the drawing board for parts of Instagram's terms of service now. "[R]ather than obtain permission from you to introduce possible advertising products we have not yet developed," Systrom explains, "we are going to take the time to complete our plans, and then come back to our users and explain how we would like for our advertising business to work."

And as far as the mass confusion over the policy changes goes? Systrom is "sorry for that" and "focused on making it right."
